Lay modalities to partly open highway, SC tells Haryana, Punjab police

NEW DELHI – The Supreme Court today asked senior police officials of Haryana and Punjab to meet in a week to lay down modalities for the partial opening of the highway along the Punjab-Haryana border, for ambulances, senior citizens, women, students, essential services and any daily commuters of the nearby area. The top court said that if both sides resolve the modalities, they need not wait for the court's order and implement the resolution immediately.

 

Further, the top court rejected the Haryana government's plea seeking a stay of the Punjab and Haryana High Court's order to direct a judicial probe into the death of a protesting farmer allegedly due to a bullet fired by police. The apex court said that the judicial panel's finding will be an opinion, and it will be for the high court to decide whether to accept it or not.

 

The bench of Justice Surya Kant and Justice Ujjal Bhuyan also noted the names given by both states for an independent committee to look into the various demands of protesting farmers at the Punjab-Haryana border. The court said that it would pass an order on Aug 22 regarding the composition of the committee and its mandate. On Jul 24, the top court had asked the governments of Punjab and Haryana to suggest some names for the committee, which could comprise eminent persons who could reach out to farmers and other stakeholders to find a viable solution to their demands.

 

The top court was hearing a petition by the Haryana government against the Punjab and Haryana High Court's Jul 10 order directing the state government to open the Punjab-Haryana Shambhu border within a week. The border had been closed since February when several farmers from Punjab began their march towards Delhi for various demands, including one for a legal guarantee for minimum support price for all crops, based on the formula recommended by the M.S. Swaminathan Commission.

 

Thereafter, the Haryana government had barricaded the Ambala-New Delhi national highway to stop the march. The farmers have been camping at the border since then.  End
