Govt rejects apex court's suggestion of 'creamy layer' in SC, ST quota

NEW DELHI – The Cabinet today rejected the Supreme Court's suggestion that the government should evolve a policy to identify the "creamy layer" among Scheduled Castes and Scheduled Tribes and take them out of the fold of reservation. Minister of Information and Broadcasting Ashwini Vaishnaw today said that the Cabinet discussed the apex court's recent decision on subclassification of Scheduled Castes and Scheduled Tribes.

 

"Cabinet's well thought out view on SC, ST reservation is that the NDA government is committed to (B.R.) Ambedkar's constitutional rules. As per Ambedkar's constitutional provisions, there is no place for creamy layer in SC, ST reservation," said Vaishnaw.

 

The Cabinet's view is that the government will follow Ambedkar's constitutional provisions on the issue of reservation for Scheduled Castes and Scheduled Tribes, the minister said. Ambedkar was the chairman of the Drafting Committee of the Indian Constitution and is considered as its chief architect.

 

On Aug 1, the top court upheld subclassification within Scheduled Castes and Scheduled Tribes for the purpose of reservation. Justice B.R. Gavai along with four other judges batted for introducing exclusion of "creamy layer" in reservations among Scheduled Castes and Scheduled Tribes that was already followed for Other Backward Classes.

 

The "creamy layer" concept places an income ceiling on reservation eligibility that ensures the beneficiaries are those in a community that need quotas the most.  End
