SC asks govt to set up dashboard on misleading medicine advertisement complaints

NEW DELHI – The Supreme Court today asked the Ministry of Ayush to set up a dashboard for complaints received from all stakeholders and state licensing authorities against misleading advertisements on medicinal or allied healthcare products. This will help with data coming into the public domain and being available to all consumers. The top court was hearing a case against Patanjali Ayurved Ltd for misleading advertisements of its Ayurvedic products.
The top court today noted that it appeared in some cases in states such as Chhattisgarh, Gujarat, Delhi, and West Bengal, a large number of complaints were forwarded to other states. "There is no data given by receiving states on action taken...This leaves consumers feeling helpless and in the dark regarding action taken on the complaints. The Ministry of Ayush must set up a dashboard for all states to furnish details," said the Bench of Justice Hima Kohli and Justice Sandeep Mehta. This will also address the issue that prosecution under the Drugs and Cosmetics Act, 1940, is hit by unavailability of complaints, the court added.
Further, the top court asked the Uttarakhand government to take a decision on the suspension of licences of 14 ayurvedic products in two weeks. The court's order came after it was informed that sale of 14 ayurvedic products by Patanjali was continuing as the suspension order had been cancelled and a fresh decision on the same was pending with the state government.
The apex court is also hearing a contempt case against Patanjali Ayurved's Co-founder Baba Ramdev and Managing Director Acharya Balkrishna for publishing misleading advertisements and violating the top court's order. In February, the apex court had come down sharply on Patanjali for its misleading advertisements on the medicinal efficacy of its products and barred it from advertising or branding its products that claimed to treat ailments specified in the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954. The court had also cautioned Patanjali Ayurved, the parent company of Patanjali Foods Ltd, from making statements against any system of medicine.
Today, shares of Patanjali Foods closed up 0.4% at 1,708.20 rupees on the National Stock Exchange. End
