--CONTEXT:Jharkhand HC gave bail to Soren on Jun 28 in land scam case
NEW DELHI – The Supreme Court today rejected the Enforcement Directorate's plea against the Jharkhand High Court order granting bail to Jharkhand Chief Minister Hemant Soren in a money laundering case linked to a land scam.
"We are not inclined to interfere with the impugned order (of the high court). Since observations made by the learned judge are with regard to bail, the same would not influence learned trial judge either at the stage of trial or any other proceedings," said a Bench of Justice B.R. Gavai and Justice K.V. Viswanathan. "We don't want to observe anything more...If we observe, you (Enforcement Directorate) might be in difficulty. Very well-reasoned judgment has been rendered by the learned judge," the apex court said.
The Enforcement Directorate had arrested Soren on Jan 31 under the Prevention of Money Laundering Act in a case related to his alleged ownership of a parcel of land measuring 7.16 acres in Bajra area of Jharkhand's Ranchi district. The arrest came after the agency questioned Soren at his residence in Ranchi for several hours.
On Jun 28, the high court had given bail to Soren, against which the probe agency moved the apex court. The Enforcement Directorate said the high court's order was erroneous and contested its finding that there was no prima facie evidence that Soren was guilty under the Prevention of Money Laundering Act, 2002. The agency said the high court's decision to give bail to Soren was also illegal.
Earlier, Soren had resigned from the post of chief minister, just before his arrest by the Enforcement Directorate. He was succeeded to the post by Champai Soren. This month, however, Champai Soren resigned from the post after the Indian National Developmental Inclusive Alliance legislators elected Hemant Soren as the leader. Thereafter, Soren took oath as the chief minister of Jharkhand. End
