Delhi HC allows Dish TV to file reply in suit by Gulf DTH

NEW DELHI – The Delhi High Court today allowed Dish TV India Ltd to file a written statement in a suit by Gulf DTH FZ LLC seeking a permanent injunction against the Indian company distributing set-top boxes and smart cards in West Asia and North Africa. Rejecting an earlier order by a single judge of the court, a division bench said Dish TV's statement should be taken on record and the suit should proceed from there.

 

Gulf DTH FZ operates a direct-to-home satellite subscription pay television platform in West Asia and North Africa. It claims to have exclusive licences granted by copyright owners to transmit, by satellite and other means, various television channels in the region.

 

Gulf DTH FZ filed the suit seeking a permanent injunction restraining Dish TV from distributing set-top boxes and smart cards in the region, recharging its pay television services, and activating any smart cards for use by consumers, along with damages.

 

In 2015, the court issued summons to Dish TV India. In 2016, a single judge closed the company's right to file a written statement as it failed to do so within the mandated 120 days. 

 

At 1525 IST, shares of Dish TV India were down 1.3% at 15.02 rupees on the National Stock Exchange.  End
