SEBI notifies FPI rules tweaks on fee payment in rupees instead of dollars

MUMBAI - The Securities and Exchange Board of India Friday notified in The Gazette of India amendments to its foreign portfolio investors regulations, changing the currency for payment of fees by foreign portfolio investors to rupees from US dollars. The FPI regulations have also been amended to allow SEBI to capture the date of incorporation of the FPI in the registration certificate. The SEBI board had approved these amendments to FPI regulations at its board meeting on Jun. 19, along with a similar proposal to amend its foreign venture capital investors regulations.

 

SEBI also notified Friday an amendment to its custodian regulations to replace annual collection of fees from custodians with collection on a monthly basis. The SEBI board had approved a proposal to this effect at its Jun. 19 meeting.

 

Prior to the amendment, a category 1 FPI had to pay a registration fee of $2,500, and a category 2 FPI had to pay $250. With the amendment notified in the Gazette, a category 1 FPI will now have to pay INR 230,000 in eligible foreign exchange equivalent, and a category 2 FPI will similarly need to pay INR 23,000. SEBI has based this change on the rate of INR 92 per dollar, as per back-of-the-envelope calculations. The currency change also applies to all other applicable fees for FPIs and SEBI has specified the rupee amounts for these fees in the amended regulations.  End
