The Delhi High Court has held that the capital grant subsidy given by the National Highways Authority of India to its concessionaires would not be subject to a withholding tax under Section 194C of the Income Tax Act, 1961. The court has dismissed the Income Tax Department's challenge and held that the subsidy granted by the highways authority could not possibly have been construed as payment made for a work undertaken by the contractor.
